A shattering revelation at the Fuellmich trial: he was targeted by the German federal services, who were instructed to infiltrate his entourage, compromise his reputation and cooperate with the public prosecutor to facilitate his indictment. It was a real twist of theater which took place on Tuesday April 2, during the 9th day of the trial against Reiner Fuellmich [1] . One of the three defense lawyers, Christof Miseré, read in court a top secret document, probably coming from the BKA, the federal criminal police office, or the BNA, the federal domestic intelligence service. This is a file, opened in August 2021, which reveals that the German National Security had carried out an in-depth investigation into the activities of Reiner Fuellmich, considered a dangerous personality due to his considerable audience [2] and filed in as a threat to democracy and internal security!

Were it the political projects of Reiner Fuellmich which represented a “threat” to German Security, or more broadly his legal actions (Corona Committee, Grand Jury [3] ) against the instigators of the repressive measures under the pretext of the “Covid pandemic”?

Destroy Fuellmich or his political projects?

Fuellmich indeed wanted to get involved in politics and had announced his candidacy for the federal elections, on the list of the citizens' party Die Basis, of which he is one of the founders. However, if the police documents clearly identify the lawyer as being a threat, they do not provide any proof of his supposed “anti-democratic tendencies”, nor of a risk of disturbing public order or endangering the “ democratic process”. Was Reiner Fuellmich not defending democratic principles such as freedom of expression and transparency?

Recommendations:

Corona Committee funds, money diverted or secured?

Currently, only one charge is brought against Reiner Fuellmich by the Göttingen public prosecutor's office, out of the eighteen with which he was initially accused. It concerns a loan of €700,000 made by Fuellmich, from the funds of the Corona Committee. Reiner Fuellmich's defense nevertheless claims to have provided the court with all the documents proving that Fuellmich had completed all the necessary formalities to legally borrow the money, with the agreement of Viviane Fischer. Money that he had agreed to repay following the imminent sale of his house in Germany. The defense also explains that Reiner and Viviane had wanted to secure the funds of the Corona Committee, by distributing them among different accounts, because they feared that the Committee's account was potentially threatened.

Added to this is a whole series of oddities in the legal procedure. A first indictment file was initially submitted to an experienced prosecutor at the Göttingen public prosecutor's office and rejected for lack of substance in the accusation. Following this, a young prosecutor, the one currently in charge of the case, was reportedly transferred from the Hannover public prosecutor's office. He would then have taken over the case and initiated official proceedings, leading to an arrest warrant against Fuellmich issued at the federal and then European level in March then May 2023.

Infiltration: what murky role played by the police?

If we refer to the date of the file compiled by the German State Security, we see that at the time of the opening of the procedure against Reiner Fuellmich, the instructions of the police services were to facilitate criminal proceedings by cooperating with the public prosecutor in order to secure a charge. So, is the lawsuit against Fuellmich the consequence of serious embezzlement? Is this the result of resentments accumulated by members of the Committee who remained in the shadows? Or is it above all the result of the interference of agents infiltrated in the entourage of Reiner Fuellmich, with the mission of recruiting “appropriate third parties”, used to launch accusations and request the arrest of the figure of figurehead of the Corona Committee?

A plaintiff who lacks confidence

We indeed notice strange reluctance or fears on the part of Justus Hoffmann who, according to our German informants, would have agreed to file a complaint on the condition that Reiner Fuellmich would not have the opportunity to speak publicly before the start of the trial. . He also requested a closed trial, which was rejected by the court.

However, this explains why Reiner Fuellmich, who was then residing in Mexico, was informed neither of the complaint filed against him, nor of the arrest warrants issued against him. What was the role of State Security in the incredible conditions of the lawyer's arrest in Tijuana, in the absence of any international arrest warrant?

A kidnapping on Mexican soil?

Following the loss of his passport, Reiner Fuellmich was summoned to the German embassy on October 11, 2023, to collect a new passport. It was there that he was illegally arrested and escorted onto a plane to Germany so that he could be arrested, this time legally, as soon as he set foot on German soil.

Since then, Fuellmich has been incarcerated at the Rosdorf high-security prison in conditions that appear disproportionate to the alleged offenses. His requests for conditional release, pending a verdict, have been systematically rejected. Justification for the objection: a high risk of flight abroad.

It is important to note that the fourth member of the Corona Committee, Viviane Fischer, was not allowed to join the plaintiffs, despite two successive requests. Is it because she, like Reiner, borrowed money from the Corona Committee, but without being prosecuted?

Trap, revenge, or series of misunderstandings?

Last important element of the case: the money that Reiner is accused of having embezzled is no longer in his possession. However, he is accused of not having repaid it following the sale of his property (which was provided for in the contract). This is, again, the consequence of incredible procedural anomalies. Among the plaintiffs against Reiner Fuellmich is a fifth lawyer, Marcel Templin. He had been mandated by Fuellmich, as part of the preparation of a series of Class Actions, to collect mandates and deposits of funds from those who wished to join international collective proceedings. However, following irregularities in data protection, Fuellmich had divested the Templin firm of the file and was entrusted with the vast majority of mandates directly.

Marcel Templin nevertheless managed to add a debt recovery request to the sale of Reiner Fuellmich's property, estimating that with interest, an amount of 1.15 million euros was owed to him. This resulted in almost the entire amount of the real estate sale being paid directly into Marcel Templin's account, leaving Reiner unable to reimburse the Corona Committee and thus justifying the proceedings against him. Unstoppable trap and timing. Intentional or not?

Revelations that call into question the impartiality of justice

Let's return to the consequences of the police file on Reiner Fuellmich, read by his lawyer, in court. Faced with judges who had become livid and a prosecutor unable to contain a nervous chuckle, Reiner's lawyer called for the trial to be suspended, believing that the neutrality of justice could not be guaranteed. He also announced his intention to file several complaints. His request for suspension was, however, rejected by the judges, who denied having knowledge of a record of the accused and the procedures recommended by the police. The Fuellmich trial will therefore continue as planned. The next sessions are planned for April 19 and 24, 2024.
